This work helps highlights how the innovations in Flathman's thought have shaped the field of political theory and will be of interest to students and scholars alike.

Reviews evidence which suggests that there may be little or no direct introspective access to higher order cognitive processes. Ss are sometimes unaware of the existence of a stimulus that importantly influenced a response, unaware of the existence of the response, and unaware that the stimulus has affected the response. It is proposed that when people attempt to report on their cognitive processes, that is, on the processes mediating the effects of a stimulus on a response, they do not do (...) so on the basis of any true introspection. Instead, their reports are based on a priori, implicit causal theories, or judgments about the extent to which a particular stimulus is a plausible cause of a given response. This suggests that though people may not be able to observe directly their cognitive processes, they will sometimes be able to report accurately about them. Accurate reports will occur when influential stimuli are salient and are plausible causes of the responses they produce, and will not occur when stimuli are not salient or are not plausible causes. Disputes regarding the ethics of work by children have intensified in recent years, with little resolution. The impasses stem from failure to recognize the diverse forms of child work and a lack of empirical research regarding its causes and consequences. We report on data gathered in Brazil’s export-oriented shoe industry, which is notorious for the employment of children. Central findings are: 1) the causes of child work have less to do with backwardness and more to do with how shoe workers (...) are integrated into the global order; 2) local employers and children regard this work as benign, but the U.S. government sees it as hazardous to children and unfair to U.S. producers; 3) efforts to remove children from the shoe industry have been frustrated by local resistance and raise ethical questions; and 4) in certain circumstances, efforts to eliminate hazards from the workplace are morally superior to campaigns to remove childworkers from employment. Husserl's marginal remarks in Kant und das Problem der Metaphysik clearly do not reflect the same intense effort to penetrate Heidegger's thought that we find in his marginal notes in Sein und Zeit. Merely in terms of length, Husserl's comments in the published German text occupy only one-third the number of pages.2 Pages 1-5, 43-121, and 125-1673 contain no reading marks at all-over half of the 236 pages of KPM. This suggests that Husserl either read these pages with no intention (...) of returning to the text or skipped large parts of the middle of the text altogether.4 His remarks often express frustration or a resigned recognition of the now unbridgeable, irrevocable gap between himself and Heidegger. This chapter combines formal models of how the fitness of a collective can become decoupled from the fitness with more empirical work on the volvocine algae. It uses the Volvox clade as a model system. It describes the evolution of altruism in the volvocine green algae. This chapter suggests that altruism may evolve from genes involved in life-history trade-offs. It shows the several cooperation, conflict, and conflict mediation cycles in the volvocine green algae. This cycle of cooperation, conflict, and conflict (...) mediation drives evolutionary transitions in individuality. (shrink)

Charles Foster and Jonathan Herring are to be congratulated on their useful presentation of the roles played by concepts of personhood and identity in English medical law. 1 However, I fear that the project they have undertaken here is misconceived. It is an interesting and important misconception, which is widely shared in the literature on medical law and ethics; but a misconception it remains. The problem is this. What we call ‘the Law’ is in fact a complex assemblage of institutions, (...) rules, accredited persons, practices and systems. What it is not is a self-sufficient, integrated and self-interpreting system of doctrine. As such it does not have a clear structure which we can excavate and the idea that we can find concepts which explain and unify that structure at some deep level is thus quixotic. To approach ‘the Law’ in that way is to pursue a chimaera. We should instead... (shrink)

Bioethics has been subject to considerable social criticism in recent years. One criticism that has caused particular discomfort in the bioethics community is that bioethicists, because of the way their work is funded, are involved in profound conflicts of interest that undermine their title to be considered independent moral commentators on developments in biomedicine and biotechnology. This criticism draws its force from the assumption that bioethics is, or ought to be, a type of normative social criticism. Versions of this criticism (...) come from both the political left and right. For instance, such criticisms include allegations that bioethics is inherently socially conservative, that it is inherently “pro-technology”, that it lays spurious claims to moral and social authority and expertise, that its focus on autonomy links it to neoliberal theories of choice, and that it is an ideological mystification of real social relationships and political power. This commentary paper analyses the problem of bioethical conflict of interest, and argues that the types of conflict of interest facing bioethics are inherent to the role of “public intellectual” that bioethicists generally wish to assume. The paper defends this conception of the role of the bioethicist, arguing that bioethicists should be interested and openly so. (shrink)

Why is it that some business managers appear to behave differently in private and at work? How, if at all, are the decisions managers make affected by the nature of their organisations? What impact do organisational values have on the moral autonomy of managers? A research project into these questions is now under way in three disparate Australian business firms and this paper sets out the premise underlying it. For purposes of research the general premise is that the moral character (...) of a business influences the moral judgements and actions of its members. More specifically, it is suggested that the economic paradigm renders a business organisation amoral rather than moral or immoral, and as a result moral responsibility comes to be assigned to individual members. However, the socio-cultural nature of such firms interferes with the ability of managers to exercise moral autonomy. Governed as it is by the market or laws of economics, the amoral organisation is likely to transform its members into individuals without moral standards. (shrink)

The authors find East Asians to be holistic, attending to the entire field and assigning causality to it, making relatively little use of categories and formal logic, and relying on "dialectical" reasoning, whereas Westerners, are more analytic, paying attention primarily to the object and the categories to which it belongs and using rules, including formal logic, to understand its behavior. The 2 types of cognitive processes are embedded in different naive metaphysical systems and tacit epistemologies. The authors speculate that the (...) origin of these differences is traceable to markedly different social systems. The theory and the evidence presented call into question long-held assumptions about basic cognitive processes and even about the appropriateness of the process–content distinction. (shrink)

This case deals with the corporate response to a crisis and the successful evacuation of approximately 900 hotel guests, staff, and family members of staff whowere stranded in the Fairmont New Orleans hotel by Hurricane Katrina. This rescue effort, spearheaded by managers at the sister Fairmont hotel in Dallas, Texas, was completed shortly after 12 a.m. on Friday, September 2, 2005, when the last bus with evacuees pulled into the Dallas Fairmont after making a round trip of more than 1000 (...) miles — and about 64 hours after planning began. This case is particularly significant for lessons that may be derived about crisis management and leadership, and it also raises several interesting ethical issues. The case, which relies on field research plus secondary sources, is appropriate for business ethics and business strategy courses. (shrink)

On autobiographical memory tests (AMTs) using positive and negative cue words, research has consistently found that depressed individuals (relative to nondepressed controls) are more likely to recall overgeneral memories (OGMs) and are less likely to recall specific memories. A total of 56 undergraduates who scored high or low on a measure of depression were shown positive and negative word cues and event cues in a computerised AMT. Dysphoric college students made significantly fewer specific and more categoric (overgeneral) responses than controls, (...) but did not differ from controls in terms of extended responses. Results suggest that the difference in memory specificity between low and high dysphoric students generalises across word and event cues and that a computerised version of the AMT can be used as an alternative to interviews as a form of administration. Richard Wolin, in his article 'Nazism and the Complicities of Hans-Georg Gadamer: Untruth and Method' ( New Republic , 15 May 2000, pp. 36-45), wrongly accuses Gadamer of being 'in complicity' with the Nazis. The present article in reply was rejected by the New Republic , but is printed here to show that Wolin in his article is misinformed and unfair. First, Wolin makes elementary factual errors, such as stating that Gadamer was born in Breslau instead of Marburg. He (...) relies on a highly questionable source, Teresa Orozco, as 'definitive'. He argues often by misconstruing the evidence and guilt by association. For instance, he associates Gadamer with Werner Jaeger, with whom he disagreed and had little contact. Finally,he misinterprets basic terms in Gadamer's hermeneutics, Vorurteil and authority, attributing to them the popular sense of these terms instead of their place in Gadamer's hermeneutics. Vorurteil , popularly translated as 'prejudice', but better rendered as 'prejudgment', refers to the prior knowledge that one needs in order to understand a situation or a text. In some cases, this is part of the inherited tradition. Authority refers to the respect one pays to those one recognizes as having more knowledge than oneself: one's doctor, or parent, or teacher, a judge, or certain texts. It is not an abject surrender to all authority but the necessary respect for authority in human relationships and in society in general. By misconstruing these terms, Wolin attempts to discredit Gadamer's general philosophy,not just to demonstrate a connection to the Nazis. At the end, his argument turns into a misinformed general political attack on Gadamer as an enemy of Enlightenment values. (shrink)

The fitness of any evolutionary unit can be understood in terms of its two basic components: fecundity (reproduction) and viability (survival). Trade-offs between these fitness components drive the evolution of life-history traits in extant multicellular organisms. We argue that these trade-offs gain special significance during the transition from unicellular to multicellular life. In particular, the evolution of germ–soma specialization and the emergence of individuality at the cell group (or organism) level are also consequences of trade-offs between the two basic fitness (...) components, or so we argue using a multilevel selection approach. During the origin of multicellularity, we study how the group trade-offs between viability and fecundity are initially determined by the cell level trade-offs, but as the transition proceeds, the fitness trade-offs at the group level depart from those at the cell level. We predict that these trade-offs begin with concave curvature in single-celled organisms but become increasingly convex as group size increases in multicellular organisms. We argue that the increasingly convex curvature of the trade-off function is driven by the cost of reproduction which increases as group size increases. We consider aspects of the biology of the volvocine green algae – which contain both unicellular and multicellular members – to illustrate the principles and conclusions discussed. (shrink)

This book examines two questions: Do people make use of abstract rules such as logical and statistical rules when making inferences in everyday life? Can such abstract rules be changed by training? Contrary to the spirit of reductionist theories from behaviorism to connectionism, there is ample evidence that people do make use of abstract rules of inference -- including rules of logic, statistics, causal deduction, and cost-benefit analysis. Such rules, moreover, are easily alterable by instruction as it occurs in classrooms (...) and in brief laboratory training sessions. The fact that purely formal training can alter them and that those taught in one content domain can "escape" to a quite different domain for which they are also highly applicable shows that the rules are highly abstract. The major implication for cognitive science is that people are capable of operating with abstract rules even for concrete, mundane tasks; therefore, any realistic model of human inferential capacity must reflect this fact. The major implication for education is that people can be far more broadly influenced by training than is generally supposed. At high levels of formality and abstraction, relatively brief training can alter the nature of problem-solving for an infinite number of content domains. (shrink)

In ‘Salvaging the Concept of Nudge’ Yashar Saghai performs an important clarificatory task which certainly advances our philosophical and ethical understanding of nudges in public policy, and in healthcare ethics in particular.1 In this brief commentary I identify some issues which could usefully be taken forward in subsequent discussions.A central difficulty with ethical discussions of nudging is that insufficient care is taken to distinguish two morally important features of nudges. The first, which Saghai very properly concentrates upon, is the mechanism (...) of nudging. Nudges rely on psychological properties of human decision-makers as the way in which their intended effects are brought about. Much of the ethical concern with nudges focuses on just this. Whatever the motive of the nudger, or the objective of the nudge, or the ex ante or ex post ratification of the nudge by the nudge, operating through influence, impulse or non-rational features of the nudgee's decision-making is wrong. The nature of this wrongness can be spelled out in different ways, and which one of these we choose has important implications for the precise ethical argument …. (shrink)

Drawing heavily on Wittgenstein, Winch’s The Idea of a Social Science advanced a forceful and still valuable critique of positivist/empiricist conceptions of social science. In its more self-confident assertions concerning the nature of philosophy and society, however, Winch failed to recognize Wittgenstein’s acknowledgement of and appreciation for the indeterminacy and unsettled character of social and moral life.
